Terms of Use

These Terms of Use ("Terms") govern your access to and use of TheraTrack (the "App"), operated by Waqar Psychology ("Waqar Psychology," "we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the App.

1. Purpose of the App

TheraTrack is a mental health and wellbeing application designed to assist users with self-monitoring and self-management through features that may include:

  • Mood tracking;

  • Pain tracking;

  • Sleep and wellbeing monitoring;

  • Psychological questionnaires and self-assessments;

  • Psychoeducational articles and resources; and

  • Other wellness-related tools and features.

The App is intended solely for informational, educational, and self-management purposes.

 

2. Not Medical or Psychological Advice

The App does not provide medical advice, psychological treatment, diagnosis, or crisis intervention services.

The information and content available through the App are general in nature and are not a substitute for professional medical, psychological, psychiatric, or other healthcare advice, diagnosis, or treatment. You should always seek the advice of an appropriately qualified health professional regarding any medical or mental health concerns.

 

3. No Therapeutic Relationship

Use of the App does not establish a psychologist-client relationship, therapeutic relationship, or any other professional relationship between you and Waqar Psychology or its practitioners.

Any information entered into or generated by the App should not be relied upon as professional advice.

 

4. Crisis and Emergency Situations

The App is not intended for use in emergencies.

If you are experiencing thoughts of self-harm, suicidal thoughts, a mental health crisis, or any medical emergency, you should immediately contact emergency services, attend your nearest emergency department, or contact an appropriate crisis support service.

 

5. User Eligibility

You must be at least 18 years of age or have the consent of a parent or legal guardian to use the App.

You agree to use the App only for lawful purposes and in accordance with these Terms.

 

6. User Responsibilities

You agree to:

  • Provide accurate information when using the App;

  • Maintain the confidentiality of your account credentials;

  • Use the App responsibly and not interfere with its operation or security;

  • Refrain from attempting to copy, modify, reverse engineer, or exploit the App; and

  • Accept responsibility for all activities conducted through your account.

You acknowledge that any information, insights, or reports generated by the App are dependent upon the accuracy and completeness of the information that you enter.

 

7. Subscription Services and Billing

Certain features of the App require an active paid subscription.

By purchasing a subscription:

  • You authorise payment through your Apple ID account upon confirmation of purchase.

  • The subscription is billed on a monthly basis.

  • Your subscription automatically renews each month unless cancelled by you.

  • Your subscription will continue to roll over and you will continue to be charged the applicable monthly subscription fee until you cancel your subscription.

  • Payment for renewal will be charged to your Apple ID account within 24 hours prior to the end of the current subscription period.

  • You may cancel your subscription at any time through your Apple ID Account Settings.

  • Cancellation prevents future renewals only. No refunds or credits are provided for any unused portion of the current billing period unless required by applicable law.

  • Following cancellation, you will continue to have access to subscription features until the end of your current paid subscription period.

We reserve the right to modify subscription pricing, features, and offerings. Any changes will apply prospectively and in accordance with Apple's subscription policies and applicable laws.

 

8. Free Trials and Promotional Offers

From time to time, we may offer free trials or promotional subscriptions.

Unless otherwise stated, any free trial or promotional period will automatically convert to a paid monthly subscription at the end of the trial period and continue to renew automatically each month until cancelled by you.

You may cancel during the trial period to avoid being charged.

 

9. Privacy

Your privacy is important to us. Our collection, use, storage, and disclosure of personal information are governed by our Privacy Policy available at:

By using the App, you acknowledge and consent to our handling of your information in accordance with our Privacy Policy.

 

10. Intellectual Property

The App and all associated content, including software, text, graphics, educational materials, questionnaires, designs, logos, trademarks, and other materials, are owned by or licensed to Waqar Psychology and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App solely for your personal, non-commercial use.

You may not reproduce, distribute, modify, sell, lease, or otherwise exploit any part of the App without our prior written consent.

 

11. Availability and Changes

We reserve the right to modify, suspend, discontinue, or update the App or any feature of the App at any time and without prior notice.

We do not guarantee uninterrupted, secure, or error-free operation of the App.

 

12. Disclaimer of Warranties

To the fullest extent permitted by law, the App is provided on an "as is" and "as available" basis.

Waqar Psychology disclaims all warranties, express or implied, including any warranties of:

  • Merchantability;

  • Fitness for a particular purpose;

  • Accuracy;

  • Reliability;

  • Availability; and

  • Non-infringement.

We make no representations that the App will meet your requirements or that the information generated by the App will be suitable for any particular purpose.

 

13. Limitation of Liability

To the maximum extent permitted by law, Waqar Psychology and its directors, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of, or inability to use, the App.

Our total liability arising from or relating to the App shall not exceed the total amount paid by you for the App during the twelve months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot be excluded under applicable consumer protection laws, including the Australian Consumer Law.

 

14. Indemnity

You agree to indemnify and hold harmless Waqar Psychology, its directors, employees, contractors, and affiliates from and against any claims, losses, liabilities, damages, costs, and expenses arising from:

  • Your use of the App;

  • Your breach of these Terms; or

  • Your violation of any law or the rights of another person.

 

15. Third-Party Services

The App may contain links to third-party websites, services, or resources. We are not responsible for the content, availability, or privacy practices of third-party services.

Your use of third-party services is governed solely by their own terms and policies.

 

16. Termination

We may suspend or terminate your access to the App immediately if:

  • You breach these Terms;

  • Your use of the App is unlawful; or

  • We reasonably consider continued access inappropriate.

Termination of access does not affect any accrued rights or obligations.

 

17. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
